HP and Huawei: The Patent Layer Sanctions Couldn't Cut

For those of us who've watched the US-China tech decoupling narrative carefully, this week's news that HP has signed a WiFi technology licensing agreement with Huawei is not just a supply chain footnote. It's a crack in the clean narrative of total decoupling. HP, an iconic American tech giant, licensing patents from a company on the US Entity List. The irony isn't lost on anyone. But to me, this isn't about politics in Washington or procurement in Shenzhen. It's about the fundamental architecture of how standards work, and how the old model of 'sanctions as a scalpel' is hitting a new kind of steel. For years, the standard argument for decoupling was straightforward: restrict physical goods, starve the entity of advanced chips and capital, and the problem solves itself. We saw this in the 2020-2022 era of export controls. But that was a war fought over factories and fabs. The war today is being fought over an asset class we can't see: the Standard Essential Patent (SEP). Let me explain why this matters more than any boardroom decision. A SEP is a patent that is necessary to implement an industry standard. If you make a WiFi-enabled device, you cannot avoid the patents that cover the fundamental modulation, coding, and access mechanisms. There is no 'clean network' workaround at this layer. If Huawei holds a substantial share of WiFi 6 and 7 SEPs—and the available data suggests it ranks in the global top three across generations—then every major manufacturer, from the US to Europe to Asia, is already in Huawei's patent gravity field. HP's move is the most visible admission of this reality. The licensing agreement is not a purchase of hardware or software. It's a financial acknowledgment that the IP layer of the global ICT infrastructure is a shared commons. This is the same logic I've used in the DeFi space when explaining why composability is a double-edged sword: you can't simply 'unplug' a protocol if your entire financial application is built on its security assumptions. What's particularly interesting to me, though, is the timing. This isn't a secret back-channel deal happening in 2019. This is 2026. The US government has spent nearly a decade building a narrative of total technological isolation. The HP move signals a pragmatic pivot. We're seeing the first real indicator of what I call 'selective decoupling'—a phrase I've been using to describe the inevitable bifurcation of the tech world into sensitive and non-sensitive sectors. In my experience with community strategy during the bear market, I saw this pattern repeatedly: when the macro narrative is too aggressive, the real economy creates its own pressure valves. HP is a pressure valve. They need WiFi patents to remain competitive in consumer and enterprise hardware. They cannot wait for a political resolution that may never come. We like to think of 'Layer 2' solutions as a new frontier, but the 'Layer 2' of the global economy is the legal and patent system. It's a slow, clunky chain, but it's the one that holds the global supply chain together. The HP-Huawei deal is a reminder that true sovereignty is not about isolation. It's about who holds the keys to the standard. From a market perspective, I don't expect this to trigger a massive rally in tech stocks. But it should trigger a reassessment of the 'supply chain risk' metrics used by institutional investors. We've been too focused on the physical logistics of chips and hardware. We're now entering an era where the bottleneck is the distribution of intellectual property. That's a much harder problem to solve with tariffs or export controls. As someone who spends a lot of time thinking about the intersection of cryptography and community, I find the resilience of the SEP system to be a hopeful sign. It shows that not every door can be closed. In the crypto world, we often say that the community is the only chain that cannot be broken. This is the non-crypto version of that truth: a standard is a community of stakeholders, and it will always find a way to keep the network alive. So, what does this mean for the next 12 months? I'm watching for two signals. First, whether other American hardware giants will follow HP's lead. If Dell and Cisco start signing similar licensing agreements, it's a clear signal that the political pressure valve has reached its maximum. Second, I'm watching how the US government reacts to this. If the BIS quietly allows it, we know the policy is officially shifting to 'manageable containment' rather than 'total isolation'. My gut tells me we're at the end of the 'sanctions-as-religion' era. We're entering a period of complex, messy, pragmatic engagement. In a decentralized world, total control is a myth. The HP-Huawei deal is a reminder that the global technology system is more like a fluid network than a walled garden. The edges are porous, and the code is law. And the law, in this case, is the unbreakable standard. Stay through the dip. Rise with the builders. The 2017 ICO truth-teller in me sees this as the ultimate 'plain language' test. We can explain smart contracts and rollups to the masses, but we struggle to explain that a US tech giant just paid a 'blacklisted' Chinese firm for the rights to make our WiFi work. It's a lesson in humility for the tech world: the value is not in the box, but in the invisible layer of agreement that makes the box possible.
