But looking past the regulatory filing text into the product's execution mechanics exposes a fundamentally different reality: this is not a primitive for asset accumulation, but a structured volatility vehicle built on decaying mathematical assumptions. Based on my audit experience examining exchange-traded derivative architectures since the 2017 market cycles, retail market participants consistently misinterpret synthetic exposure as spot ownership. The proposed product does not hold a single satoshi of underlying Bitcoin or a single wei of Ethereum. Instead, it targets a daily triple return of near-month and next-month CME futures contracts. This architecture introduces a structural mechanism that institutional desks understand intimately, but retail allocators routinely ignore: the daily reset. When a fund enforces a daily reset multiplier in a high-volatility asset class, compounding drift becomes inevitable. In a sideways or oscillating market, volatility decay eats away at the principal regardless of the underlying asset's directional bias. The image of a three-times multiplier is clean; the compounding metadata confesses the long-term erosion. Yields decay, but the logic remains immutable. Cboe’s reliance on CME futures rather than spot assets is a deliberate maneuver to bypass custody and settlement friction, shifting regulatory complexity away from physical asset handling. Yet, this introduces secondary risks: roll costs, basis divergence, and margin drag. If an asset trends violently without consolidation, the daily compounding compounds losses exponentially faster than a standard spot position. The market treats the 'ETF' label as a seal of safety, forgetting that derivative wrappers trade administrative convenience for structural drag. Forensic architecture reveals the architect. The proposal indicates that traditional finance is packaging crypto volatility into familiar brokerage formats, creating a tactical instrument disguised as an allocation vehicle. As the SEC comment period progresses, the institutional footprint suggests a bifurcation of the market: spot ETFs for balance sheet reserves, and leveraged futures wrappers for short-term speculative velocity. Will the SEC approve a triple-leveraged product in a market where spot volatility routinely triggers exchange circuit breakers, or will investor protection mandates force a structural contraction before trading begins?
